By accessing and using Pivot DeskX ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

Use License

Pivot DeskX grants you a limited, non-exclusive, non-transferable license to use our Service for your internal business purposes only. You may not:

• Sell, resell, or sublicense the Service
• Modify, adapt, translate, or create derivative works from the Service
• Reverse engineer, decompile, or disassemble the Service
• Use the Service to develop competing products
• Remove or alter any proprietary notices or labels
• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems or data

This license is revocable at any time. Upon termination of your account, all rights granted are immediately revoked.

User Account

Account Creation

You are responsible for maintaining the confidentiality of your account credentials and password. You agree to accept responsibility for all activities that occur under your account. You must provide accurate, current, and complete information during registration and keep this information updated.

Account Termination

You may terminate your account at any time by contacting support. We may terminate or suspend your account immediately, without notice, for any reason, including if we believe you have violated these Terms.

Data Retention After Termination

Upon account termination, we will delete your data within 30 days, except where retention is required by law. You are responsible for exporting and backing up your data before termination.

Payment & Billing

Pricing

Pricing and billing terms are specified on our Pricing page. All prices are subject to change with 30 days notice.

Payment Processing

Payment is due according to the billing frequency you select (monthly, quarterly, or annually). We use third-party payment processors to handle billing. You authorize us to charge your payment method for all amounts due.

Late Payment

If payment is overdue, we may suspend your account access. We may also recover costs incurred in collection efforts.

Refunds & Money-Back Guarantee

We offer a 30-day money-back guarantee for new customers. If you are unsatisfied within 30 days of purchase, contact us for a full refund. This guarantee applies to initial subscription periods only.

No Refunds for Cancellation

Once your trial period ends and you begin paying, we do not provide refunds for partial months. You can cancel at any time, and your account will remain active until the end of your billing period.

Acceptable Use Policy

You agree not to use Pivot DeskX to:

• Violate any applicable laws or regulations
• Harass, threaten, defame, or abuse other users
• Upload or transmit viruses, malware, or any harmful code
• Engage in any unauthorized access or hacking attempts
• Collect or track personal information without consent
• Spam, phish, or scam other users or systems
• Violate the intellectual property rights of others
• Violate employment laws, wage and hour laws, or data protection laws when tracking employees

Responsible Employee Tracking

When using Pivot DeskX to track employees, you agree to:

• Inform employees that they are being tracked and what data is being collected
• Use tracking features only for legitimate business purposes
• Comply with all applicable employment laws and privacy regulations
• Ensure that tracking is transparent and proportionate
• Not use employee data for discriminatory purposes

Intellectual Property

All content, features, and functionality of Pivot DeskX (including but not limited to software, code, design, text, and graphics) are the exclusive property of Pivot DeskX and are protected by copyright, trademark, and other intellectual property laws.

Your data (employee information, attendance records, etc.) remains your property. We claim no ownership of your data. However, you grant us the right to use your data as necessary to provide the Service.

Limitation of Liability

To the maximum extent permitted by law, Pivot DeskX shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or goodwill
• Business interruption or loss of use
• Any damages arising from unauthorized access to or alteration of your data

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

Disclaimers

No Warranty

Pivot DeskX is provided on an "as-is" and "as-available" basis without warranties of any kind. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Service Availability

While we strive for 99.9% uptime, we do not guarantee uninterrupted or error-free service. We are not liable for downtime, data loss, or service interruptions beyond our control.

Third-Party Services

Pivot DeskX may integrate with third-party services (payment processors, etc.). We are not responsible for the performance, accuracy, or security of third-party services.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including:

• Violation of these Terms of Service
• Unlawful or fraudulent activity
• Payment default
• Our business discretion

Upon termination, your right to use the Service will immediately cease. Your data will be available for 30 days after termination for export purposes.
